Privacy policy
This policy explains what personal information we collect when you use this website or get in touch with us, why we collect it, who we share it with and the rights you have over it.
In this policy
Who we are
Independence Capital is a trading name of [legal entity name], a company registered in England and Wales under company number [company number], whose registered office is at [registered office address]. Our trading address is 1st Floor Venture House, Water Lane, Wilmslow, SK9 5AP.
We are the controller of the personal information described in this policy, which means we decide how and why it is used. We are registered with the Information Commissioner’s Office (ICO) under registration number [ICO registration number].
If you have any questions about this policy or how we handle your information, email max@independencecapital.co.uk or call 01625 238 600.
The information we collect
Most of what we hold is information you give us yourself, when you:
- fill in one of the forms on this site, such as register interest, contact, apply for a role, suggest an acquisition target or apply to participate in a fund. These ask for your name and email address, and may ask for your phone number, your role or interests, notes you choose to write and, for some forms, a CV or other file you attach;
- sign up for our newsletter or acquisition appetite updates, which asks only for your email address;
- confirm whether you meet the Financial Conduct Authority’s criteria for receiving information about investments, such as being a high net worth or sophisticated investor;
- use the leader portal after we invite you, where you can add details about your career, the business you would like to build, your preferences and messages to our team;
- email, phone or meet us.
If you agree to analytics cookies, we also collect information about how you use this site: the pages you visit, how you arrived, the device and browser you use and an approximate location derived from your IP address. This is collected by Google Analytics and is not used to identify you.
When you send a form, Google reCAPTCHA checks that it came from a person rather than an automated program. To do this it looks at your IP address, your browser and device, and how you interacted with the page, and sets a cookie. Google’s Privacy Policy and Terms of Service apply to this.
We do not ask for special category information (such as health, ethnicity or religious beliefs) and ask that you do not include it in anything you send us.
How we use it, and our lawful basis
Data protection law requires us to have a lawful basis for each use of your information. We use it:
| Purpose | Lawful basis |
|---|---|
| To reply to your enquiry and keep in touch about the opportunity you raised | Legitimate interests: responding to people who contact us and developing our business |
| To consider you for an operating, executive, non-executive or advisory role | Legitimate interests: finding the right people for the businesses we back |
| To assess an acquisition target or deal you suggest | Legitimate interests: identifying investment opportunities |
| To check you may receive information about our funds before we send it | Legal obligation: the FCA’s financial promotion rules |
| To run your leader portal account and work with you on a strategy | Legitimate interests, and steps you ask us to take before entering into an agreement |
| To send our newsletter and acquisition appetite updates | Consent, which you can withdraw at any time using the unsubscribe link in every email |
| To understand how the site is used and improve it (Google Analytics) | Consent, given through the cookie banner |
| To keep our forms free of spam (Google reCAPTCHA) | Legitimate interests: protecting the site and our inbox from automated abuse |
| To keep the site and our records secure, and to meet our legal and regulatory duties | Legal obligation and legitimate interests |
Where we rely on legitimate interests, we have weighed them against your rights and expectations. You can object at any time (see Your rights).
We do not sell your information, and we do not make decisions about you by purely automated means.
Cookies and similar technologies
This site only sets the storage it needs to work unless you choose otherwise. That includes the cookie Google reCAPTCHA needs to protect our forms from spam. Google Analytics cookies are off until you accept them in the cookie banner, and you can change your choice at any time from Cookie settings at the foot of every page.
| Name | Provider | Purpose | Kept for |
|---|---|---|---|
| ic-cookie-consent | Independence Capital | Remembers whether you accepted or rejected analytics cookies (stored in your browser, not a cookie) | Until you clear your browser storage |
| ic-portal-refresh | Independence Capital | Keeps you signed in to the leader portal (stored in your browser, only if you sign in) | 30 days, or until you sign out |
| _GRECAPTCHA | Google reCAPTCHA | Tells people from automated programs when you use a form (set when you start filling one in) | 6 months |
| _ga | Google Analytics | Distinguishes one visitor from another (only with your consent) | 2 years |
| _ga_<ID> | Google Analytics | Keeps track of your visit (only with your consent) | 2 years |
You can also block or delete cookies in your browser settings. Blocking our own storage may stop the leader portal working.
Who we share it with
We share your information only where we need to, with:
- service providers who process it on our behalf and only on our instructions: Vercel (website hosting), Resend (delivering form submissions and managing our mailing lists), Google (spam protection on our forms through reCAPTCHA, and analytics only with your consent) and the provider that hosts our leader portal;
- the businesses and management teams we work with, where you have asked us to introduce you or where you are being considered for a role with them, and only with your knowledge;
- our professional advisers, such as lawyers and accountants;
- regulators, law enforcement or other authorities where the law requires it;
- a buyer or successor if all or part of our business is sold or restructured, who would be bound by this policy.
International transfers
Some of our service providers, including Vercel, Resend and Google, store or process information in the United States. Where information leaves the UK, we make sure it is protected by an adequacy decision of the UK Government (including the UK Extension to the EU-US Data Privacy Framework) or by the ICO’s International Data Transfer Agreement or Addendum.
How long we keep it
We keep personal information only for as long as we need it for the purpose we collected it for:
- enquiries and register interest submissions: [2 years] from our last contact with you;
- CVs and role applications: [12 months], unless you ask us to keep you in mind for longer;
- investor and deal information: for as long as the relationship lasts and then [6 years], to meet our legal and regulatory duties;
- leader portal accounts: for as long as you use the portal and then [2 years], or sooner if you ask us to remove you;
- mailing lists: until you unsubscribe;
- Google Analytics data: 14 months.
After that we delete it or make it anonymous.
Your rights
Under UK data protection law you have the right to:
- ask for a copy of the information we hold about you;
- ask us to correct information that is wrong or incomplete;
- ask us to delete your information;
- ask us to restrict how we use it, or object to our using it, including for direct marketing;
- ask us to transfer information you gave us to you or another organisation;
- withdraw your consent at any time, where we rely on it. This does not affect anything we did before you withdrew it.
To use any of these rights, email max@independencecapital.co.uk. There is no charge, and we will reply within one month.
If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113.
Keeping it secure
We use appropriate technical and organisational measures to protect your information, including encrypted connections to this site, access controls on our systems and choosing service providers who meet recognised security standards. No transmission over the internet is completely secure, but we work to protect what you send us once we receive it.
Other websites
This site links to other websites, such as LinkedIn and the businesses we have invested in. We are not responsible for how they handle your information, so please read their privacy policies.
Changes to this policy
We may update this policy from time to time. The date at the top shows when it last changed. If we make a significant change, we will tell you where we reasonably can.
